I think we need reform. Current H1B system is employer dependant and make us slave. There should be more breathing space.

Something like HSMP should come. In particular, the Fresh gradutes should be allowed to start their career in a honest way, not with the manipulted resumes designed/manufactured by almighty desi consultants.

Is it for the strategy of getting all our members to take this law seriously when they are stopped by the cops and asked for papers? Unless something personally affects our members we are content in letting things happen around us........so if such laws were passed in many other states, it would definitely jolt us to action!!!!!!

For 485 you do indeed need to be in the US (for yoiu adjust status, you need to be in some status in the US). However for I-140 you need not be in the US. Can you point to any law or any link on any forum that says you need to be present for filing the I-140?

The complete GC process can be done without ever entering the US (do LC, file I-140, then do Consular processing for the final stage)

Once a person had applied for 485, till they get advance parole if they had gone out of US, the application will be dropped.
I did hear that if you are in H1 B then it is not the case, but lots of Lawyers are advising not to get out of country till the person gets advance parole.

I do remember seeing lots of discussion in one of the portals on this topic, I remember that counselor processing is the option in this type of case.

This is a complex situation, you should consult a lawyer.

Here is my interpertation,
"Cancelled without Prejuidice" means that they have cancelled the visa as it is no longer needed as they have approved you for your Permanent Residence. It also means that if you do not keep your Permanent Residence (you mentioned conditional in your note - so I'm presuming marriage based GC?) then you will have no difficulties in ever getting another visa should you ever need one.

if a visa is cancelled WITH prejudice - then you would have had great difficulty in ever getting another US Visa.

i know the character as being chinese (but it's probably definately a japanese one as well). and it means to "paint/draw" so it has huge relevance to kirupa.com. as far as the stamp goes - it could be a little more interesting. it's kind of too white and plain-jane. this is the first time I have heard such a situation. as far as I know..uscis had to do either of the two things..return the package or send reciept notice. I dont think they are allowed to keep the application fees if they dont intend to process the petition.

Please check with other people..but what your lawyer is saying does not sound right to me. Have you checked with the company sponsoring your brothers H1-B? maybe they can ask the lawyer for a definite answer.

Also, did you apply under regular processing or premium processing? if it was premium processing..USCIS had to give an answer by April end.
