Assuming & God Willing I get my GC then , how long does it take to get US Citizenship. Does it matter which state you are working in and the Queues , State Wide Differ OR its the same slab.
Can someone point me to the webpage on USCIS that tells you how long the Q is . Does it matter , what your prev. nationality before GC was like to Priority Date my country or no relation.

I am a little confused on my case. This is how it is:
I recently got married and am back in the US. My wife is employed in India and shall be filing for her H1 this year(Apr08).
At the same time,given the unsurity of H1,we shall also be going for her H4 Visas in Mar-Apr so that she can be here in the US,ASAP.
I have a few doubts/questions:
1) Since her H1 would be filed on April 1st,do I need to wait till April 1st before going for her H4 so that her application stands clean ?
and
If I go for her H4 before April 1st(say March 29th),does her H1 filing need the H4 details ?
Also,assuming during her H1 filing she didnt have H4 and then gets her H4(say on Apr 2nd) and comes to the US. Assuming her H1 gets approved,does she have to leave the country and get her H1 stamped for change of Visa from H4 to H1(note at the time of H1 application she didnt have her H4 Visas) ?
I hope I am able to explain my confusion well. Any help on this is appreciated.

Well, there is no requirement from USCIS that forces companies to revoke 140 after employees leave or get laid off from the company. Its more to do with ability to pay issue. When a company receives a ability to pay rfe, it needs to show all the financial records along with how many 140s have been applied by them. USCIS checks the financial docs and number of 140s (underline wages) to make sure that company can pay wages. Most of the time, small time consulting companies get A2P rfe so mostly they revoke the 140s but in this economy, we can't be sure about big companies too.

The most important issue is to insure that any USCIS notices come directly to you. If the RFE was sent to your address, that is a good sign. Technically, the G-28 is only for your legal representative, though sending one in as advised above would do no harm. You might also, or instead, send a letter signed by you and your wife advising that you are no longer represented and asking that all future correspondence be addressed to your home. I would then follow up with the National Customer Service Center to make sure they have correct information.

Hi,
We (me and my wife) have received RFEs to submit G-325A forms on 9/24/09 and our lawyer submitted the requested documents last week on 10/20/09, on the next day USCIS online status changed to "We have received RFEs documents and this case processing has resumed........" on very next day 10/22/09 online status changed to "RFEs sent......."
Now we (me and my wife) and our lawyer received same RFEs again thoguh our lawyer submitted requested documents.
Please share your thoughts on how should i go from here...should i submit documents again?? or should i take an info pass and try to find out whats gaing on with our cases?

I would go ahead and submit the documents again to be on the safe side. Not sure if taking Infopass would be of any help to you in this case. You dont want to take chances and risk getting a I-485 denial on the grounds of not responding to RFE. If I were you, I would send them the docs again.

Nothing other than the supporting docs:
1. expired I-94 from passport
2. 2 photos (with A# written in pencil on the back)
3. copy of I-485 receipt
4. sheet with answer to part 7 (including name and a# in header)
5. check made out to "Department of Homeland Security"

I never entered the US in the first place.
I believe you can enter as long as the visa does not expire. But make sure to check with your company lawyer.
Also make sure you have a real job/work when you enter.

Hello,
My wife and I have a pending AOS, and have our EADs.
My priority date for EB-2 is September 2004.
I plan to go back to school in Spain - starting November 2009. The program ends in December 2010. However, my EAD expires October 2010.
Is there anything I can do to keep my GC processing on track? Can I renew my EAD while I'm in Spain?

I have already EB3 PERM/I-140 approved. And now looking to file EB2 PERM with Bachelors+ 5 year Exp. (due to degree evaluation issues I am not able to file under Masters + 6 month exp).
Ok, I also have one Tradional LC (from Texas) and one RIR case (from MN) pending in BEC.
So the new case will be my 4th case.

I entered on a H4 on my New Zealand passport and it is valid 2010. I now have a H1B ie a I-797A and a new I-94 that is also valid till 2010. I'm leaving the country for the first time to go to Australia.
Do I need to get a new visa stamp for my passport?
If you want to enter US as an H1-B, you will need an H1-B visa stamp on your passport.
If I need to get a new visa stamp, do I need to go back to New Zealand or can I do it in other countries?
You can do that from any consulate. However, note that there is a possibility that the IO will need a so-called "security check" which takes 2-3 months (and sometimes, years). In that case, you will be stuck outside US (you cannot get back to US while the security check is pending). So it is advisable to go to a country where you have a place to stay for a long time, if needed. For most people, it is their home country. Also the chances of getting a security check is higher if you go to a consulate other than the consulate in your home country.
Can I travel with my passport which shows the H4 visa and carry with me my I-797A and new I-94 to re-enter the country?

I have completed 4 years on H1B and I converted to L2 status and applied for EAD(feb'10) thru my Spouse's L1 Visa.
My GC is in process and not filed my I-485 yet.
Now my question is, as if i stay L2 for 1 year and if i convert it back to H1B, will my H1 term Start all over and will i get additional 6 year term? Please provide your feedback

My husband recently changed jobs and has not updated the transfer in his H1 visa yet. I need to travel to India. Can i travel with the existing H4 with his new I-797 and salary stubs? Or do we have to updated the visas before we can travel?

New employer B, H1B cap-subject, required starting to work on July 7/27/2009 or I may loose my offer.
I-485 is pending > 180 days. I have EAD and AP in hand. On 2/4/2008 I used AP once and the entry I-94 says PAROLED until 2/3/2009.
One attorney suggested to be able to start to work for employer B on 7/27/2009, I�ll need to file a new H1B (or you call it transfer) petition before 7/5/2009, requesting the start date on Labor Condition Application to be 7/27/09. The new H1B effective date will still be 10/1/2009.
Regardless the issue of going back to H1B from parole, my question is what is my status during the gap between 7/5/2009-7/27/2009 (before LAC effective) or 7/5/2009-9/30/2009 (Before new H1B effective)?
The other question is when you apply for H1B extension/transfer after using AP, which I-94 did you gave to USCIS?
