Hi Gurus,

Here is my situation. Have H1B expiring on June 2008. Planning to Renew. I-140 approved last Month. I485 applied and pending for more than 180 days. Have EAD, AP.

Now - I am planning to switch to another job for Title , Hike. Not happy with the current company.

I have the following question :

1) If I switch,what will happen to my I-485 / I-140. do I need to reapply ? . do I lost my priority date.
2) If I go to India, what will happen to My 485/140. Can I change AOS to consular processing.

Please advise.

1. Use Ac21
2. Are you going to India for a visit or long time? you need to come before ur AP expires and get a new one(If H1 is not valid)
Otherwise you can take a vacation on H1.
For Cp you have to withdraw your 485 application and refile your application.

So guys just off the phone with a very decent IO at NSC . talked to her 30 mins, yes you are right 30 mins..which is unheard off..

the questions that I asked were very simple

Q1. Hello Maam, i would like to know the status of my I485
A1. This is not the place to ask for status

Q2: But, Maam, I wanted to know where my case stands as people with PDs and RDs later than mine (mine is March 2006 and July 26 2007) are being adjudicated
A2: Well, we cannot disclose anybody else's case, but each case is different, so we dont know

Q3: Okay, but can u tell me if my namecheck has been cleared (although i checked a week back and another IO told me it was cleared)
A3: No, for privacy purposes we cannot disclose this info

Q4: Okay then can you tell me why there was a LUD on my approved I40 on 7/13. (guess there were lots of us who had this)
A4: Yes, I can tell you that, what is your Receipt number

Q5. Here is my recpt number
A5: Okay it looks like your I140 was filed at Texas and they sent the file over to us. we consolidated that with your I485

Q6: Does that mean that my case is being worked upon
A6: No it does not mean that. This step is one of many many steps that are required for 485 processing. so this will not tell you anything

Q7: Is my case assigned to a IO
A7: No we cannot give this info, and even if you have this info, it is useless info as the center is going towards Backlog.

Q8: Then what is the meaning of processing dates as issued by USCIS
A8: They dont mean much,. they are just a gestimation of where things stand, and as off now the centers are facing backlog. there is lot of restructuring going on within the centers. The place to check is on the website., any change will be reflected there and it is upto date.

This was the gist of my call with the IO today.. w

What is the bottom line?

Sit tight and things will move only when USCIS wants.. nothing will happen otherwise..

I don't have answer to your first question. But, I went to Matamoros, Mexico in May 2010 for visa stamping. I wouldn't suggest going to Mexico if you don't have a letter from Client specifying your role on the project with project duration. I was grilled for about 20mins even though I had client letter, w2's for last 5 years. I had to stay overnight in Mexico as they have problems with their printers and could notget the visa printing done the same day. Be prepared to stay in Mexico a day or two incase if you face the same situation.

I agree with you. I am not from India and we should concentrat on the problem of the GC problem.

Guys, please don't start Indian firm bashing here. This site is being visited by people of other nationalities as well as offices of the lawmakers. We don't want to throw mush on the companies of our own country and look small. The info spgtopper has asked for is being asked by our lobbyst, so I would appreciate if you provide the relevant info.

I was initially issued pp for 5 years in India. Last year in '08 when it was expiring, i sent application for renewal of passport (NY Consulate) based on my EAD. However, instead of renewing it for another 5 years they renewed it for 1 year only. When I called the office, they said that they receive tons of pp's lon EAD which can be renewed for a year only.

Did anybody face this same problem? Can I apply for new passport based on I-485 receipt and would they issue passport for another 5 or 10 years?

Have you thought about becoming a volunteer for IV?

I filed concurrently I140/485 and PD is 2006.

He is another worthless desi lawyer. Stay away from him! Only interested in taking your money. Poor service and once you have parted with your money good luck getting any timely response by phone or email. I have had very bad experience dealing with his office and don't be fooled by recommendations on his website saying he is very responsive etc.

My employer says its the company's policy not to file for EAD or AP for all its employees. They are just filing the 485. I am sure that they(employer and lawyer) will not be giving me the 485 reciept too.

What options do I have ?

Rajiv Khanna from immigration.com held two conference calls on going back to school with a pending green card application. Not sure if your particular situation is covered but you can listen to the conference call recordings on his website. I believe these were in the April/Mat time frame.

Hi,

I have been filed in EB2 with a priority date of Feb 26 2007.
What you guys think about the possibility of my PD getting current this year?
I know that it needs a crystal ball to predict such horrendun things like PD movement, but I am just trying to get a poll on the general feeling about the spillover this year.

Hi,

They will allow you 30 minutes before your schedule appointment time.
There is a lot of parking space before the office.FP may take around 30 minutes.

If the old company not revoked, you can travel with that old I 797.

If you get an approval from your new employer when u r ome country, better ask your employer to send it to you, so that you will get I-94 with new date on it...

In port of entry they will ask for your H1 Docs and your work location if it is consulting company or client letter, in some cases may be more docs like W2's...

Its complicated and gray area, I haven't seen any success from anybody yet.:confused:

There are two ways of porting older priority date
#1 if your old PD is stuck in backlog center, file a new perm labor with exact same wordings( same category too ), this is well documented.

#2 If you have an approved labor(can be substituted also) and approved I-140, then file a new labor with any employer under any category(eb2 in your case). Once labor is approved, at the time of filling new I-140, you need to specify that you want to port priority date of previously approved I-140. Specify relavent memos too, try finding attorney who knows or have done this atleast once :D

"EB3 - Labor filed - Aug, 2004 - BackLogged - Philadelphia - 45 day letter - Replied"

priority date from above labor can only be captured if it gets approved and employer files and get I-140 approval for this labor, and then you go ahead and file a new I-140 for your already approved EB2 specifying need to recapture old PD.

This is all from top of my head w/o having any degree in relavent field, please talk to attorney before taking any action blah blah blah.......
